# Faketrade Terms of Service

These Terms of Service ("Terms") govern your use of Faketrade (the "Service"), operated by Firefly Software, LLC ("Firefly," "we," "us," or "our").
By creating an account or using Faketrade, you agree to these Terms. If you do not agree, do not use the Service.
## 1. What Faketrade Is (and Is Not)
Faketrade is a fantasy stock trading game where you trade fake US dollars and hold simulated positions. It does not use real money, so you cannot deposit or withdraw real funds, and no orders are sent to any real brokerage or exchange. All portfolio values, gains, and losses shown in Faketrade are simulated results only. Faketrade is intended for education, entertainment, and experimentation only.
## 2. No Investment Advice
Nothing on Faketrade is investment, legal, tax, or financial advice. We do not recommend specific securities or strategies, and we do not tailor any information to your personal situation. You are responsible for your own real-world decisions, and you should not make financial decisions based only on Faketrade or other users' simulated trades or portfolios. If you need advice, you should talk to a qualified professional.
## 3. Eligibility and Accounts
Faketrade is for users who are 13 years or older. If you are under 13, you may not use the Service. By using Faketrade, you confirm that you have the authority to agree to these Terms. The Service is available globally, but you are responsible for following the laws of the country or region where you live. You are also responsible for keeping your account credentials secure and for all activity that happens under your account. If you believe your account has been accessed without your permission, you should change your password and notify us.
## 4. Public Portfolios and Activity
A key part of Faketrade is transparency and learning from others. All portfolios are public, which means other users can see your simulated holdings, trades, and trading history, and your performance may appear on leaderboards or in other rankings. We may also display statistics, charts, or other information based on aggregated and anonymized user activity. By using Faketrade, you understand and agree that your in-game activity is public within the Service.
## 5. Your Content and Our Rights
Faketrade may involve information associated with your account, such as your name, username, and in-game activity. You grant Firefly Software, LLC a worldwide, non-exclusive, royalty-free license to use, display, store, reproduce, and create derivative works from your in-game activity, including your trades and portfolio performance, as needed to operate, improve, and promote the Service. This license also allows us to use aggregated or anonymized data for analytics, leaderboards, marketing, or research. We do not claim ownership over your name or other personal identifiers, but we need permission to use your in-game data to run Faketrade.
## 6. Account and Data Deletion
You may request that we delete data you have added to the system or delete your entire account. When you request deletion of your account, we will delete or anonymize your personal data within 30 days, subject to any data we must keep for legal, security, or operational reasons such as logs or backups. Some information may remain only in aggregated or anonymized form that cannot reasonably be tied back to you. Details about how we handle your data are in our Privacy Policy.
## 7. Acceptable Use
You agree that you will not use Faketrade for any illegal purpose, attempt to hack, disrupt, or overload the Service, or scrape or collect data in a way that violates applicable law or these Terms. You also agree not to impersonate other people, misrepresent your identity, or attempt to access accounts or data that do not belong to you. We may investigate suspected violations of these rules and may work with law enforcement if required.
## 8. Our Right to Suspend or Terminate Accounts
We may suspend or terminate your access to Faketrade at any time, at our sole discretion, including if you violate these Terms, if we suspect fraud, abuse, or security issues, or if we decide to discontinue the Service. If your account is terminated or suspended, you may lose access to your account, portfolios, and other associated data. Certain information may still be retained or used as described in the Privacy Policy, such as logs or aggregated statistics.
## 9. Changes to the Service
Faketrade is evolving and will change over time. We may add or remove features, change the way the game works, or temporarily or permanently stop providing the Service.
## 10. No Uptime or Performance Guarantee
We do not guarantee that Faketrade will be available at all times, that it will be error-free, secure, or bug-free, or that any data will be stored or available without interruption. Outages, bugs, and data loss can happen. We will try to run Faketrade reliably, but we cannot promise perfection.
## 11. Disclaimers
To the maximum extent allowed by law, Faketrade is provided on an "as is" and "as available" basis. We make no warranties, express or implied, about the Service, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. Simulated performance and data shown on Faketrade do not represent real trading results and cannot guarantee any real-world outcomes. You use Faketrade at your own risk.
## 12. Limitation of Liability
To the maximum extent allowed by law, Firefly Software, LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, any loss of profits, revenue, data, or goodwill, or any decisions you make or fail to make in the real world based on Faketrade. If we are found liable for any claim related to the Service, our total liability will be limited to the amount you have paid us, if any, in the 12 months before the claim, or $0 if you have not paid anything. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you, but we intend to limit our liability as much as the law allows.
## 13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules.
Any disputes arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in California, and you agree to submit to their jurisdiction.
## 14. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top, and we may also provide notice in the app or by email when changes are significant. If you continue using Faketrade after changes take effect, you are agreeing to the updated Terms.
